DEFINITIONS
Owner: is the person/s or company who owns the said property.
Guest: The person making the booking and any person they permit to enter the property.
Property: The holiday accommodation, including all fixtures, fittings, furniture and equipment managed by Jurien Bay Realty.
AUSTRALIAN CONSUMER LAW
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law.
WEBSITE
The website is used for marketing holiday homes and managing bookings. All transactions are processed in Australian Dollars (AUD).
BOOKINGS
By making a booking (via website, phone, in person, or third-party platforms), you agree to these Terms & Conditions and associated policies.
If booked through a third-party platform (e.g. AirBNB, Stayz, Booking.com) their terms may also apply.
Jurien Bay Realty acts as an agent for the Owner. All properties are individually owner. If the property becomes unavailable (e.g. sold or withdrawn) we will make reasonable efforts to provide alternative accommodation (costs may vary) or otherwise provide a full refund of monies paid.
DEPOSIT & PAYMENT
50% deposit is required at the time of booking to confirm booking unless otherwise arranged with agent.
Bookings made within 30 days of check-in require full payment.
Full balance due at least 30 days prior to arrival.
Failure to pay many result in cancellation, to extent permitted by law.
Payments:
- Direct Deposit or Credit Card (Visa/Mastercard)
- 1.7% Credit Card surcharge (non-refundable)
BOOKING CONFIRMATION
A booking is confirmed once the deposit and $25 non-refundable booking fee is received.
SECURITY HOLDING DEPOSIT
Credit Card details may be held as security.
Alternatively, a $500 refundable holding deposit may be required.
Deductions may be made for:
- Damage to property/items
- Missing Items
- Excess cleaning
- Unpaid charges
All deductions will be reasonable, itemised and reflect actual costs. Evidence will be provided upon request.
CHANGE OF OWNERS
When a booking is made, the deposit is accepted for the owner at that time. If the property is for sale and the ownership changes or the owner removes their property from the Holiday Accommodation Management before your stay, we cannot guarantee that the property will remain available. We cannot accept responsibility for decisions made by a new owner. However, if the property is sold or withdrawn from Holiday Accommodation Management, you will be notified as soon as possible so we can find an alternative property (subject to availability), or you can organise alternative accommodation if necessary, or a Full Refund will be provided.
ALTERNATIVE ACCOMMODATION
At times situations arise which we have no control. Jurien Bay Realty reserves the right to move visitors to alternate accommodation (subject to availability) at their discretion or at the direct instruction of the property owner. In this case, we will notify you as soon as possible and make every endeavour to ensure you are happy with your new holiday property. If we find the property suitable a refund may not be applied as we have done everything in our power to find equivalent accommodation.
LISTED PROPERTIES FOR SALE
If your holiday property is listed for sale while you are in residence, the occupier agrees to allow the owner or agent to conduct inspections with prospective purchasers at a mutually convenient time, by appointment.
SEAFRONT ESTATE POOL USAGE
Swimming pool and toddler wading pool (access via gated key entry) admittance is from 8.00am-7.00pm
The common property area (pool, wading pool for toddlers, BBQ/grassed areas) is for use of guests staying at the Seafront Estate and are camera monitored for security purposes.
Pool hours and complex rules must be followed for the safety and enjoyment of all guests, any misuse of the pool area, including access outside permitted hours will result in immediate eviction and a ban from future stays.
